1. Introduction & Acceptance

1.1 Welcome to MoroccoNaut

Welcome to MoroccoNaut ("the APP"), a comprehensive digital travel companion designed to enhance your experience exploring the Kingdom of Morocco. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and United Behavioral and Cognitive Group SARL ("UBCG", "we", "us", or "our").

1.2 Acceptance of Terms

Your use of the APP constitutes acceptance of:

• Our Privacy Policy
• Any additional guidelines, rules, or policies published within the APP
• All applicable Moroccan laws and regulations

1.3 Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will notify you via in-app notification and/or email
• Changes become effective 30 days after notification
• Continued use after the effective date constitutes acceptance
• Material changes require your explicit acceptance before using updated features

3. User Eligibility & Account

3.1 Age Requirements

To use MoroccoNaut, you must:

• Be at least 13 years of age
• If between 13-18 years old, have parental or guardian consent
• Have the legal capacity to enter into binding agreements

3.2 Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.3 Account Security

You are responsible for:

• Creating a strong, unique password
• Enabling two-factor authentication (recommended)
• Not sharing your account with others
• Logging out on shared devices
• Reporting suspicious activity promptly

3.4 Account Termination

You may delete your account at any time through:

• Settings > Account > Delete Account
• Emailing privacy@ubcg.net

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other legitimate business or legal reasons.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the APP to:

• Plan and organize your travel in Morocco
• Search for and book tourism services
• Access safety and emergency information
• Share genuine reviews and experiences
• Engage constructively with the community
• Download content for personal, offline use

4.2 Prohibited Conduct

You agree NOT to:

Harmful Content

• Post content that is defamatory, obscene, or offensive
• Share content promoting violence, hatred, or discrimination
• Upload sexually explicit or inappropriate material
• Distribute malware, viruses, or harmful code

Fraudulent Activities

• Create fake accounts or impersonate others
• Post false or misleading reviews
• Engage in any form of fraud or scam
• Use the APP for money laundering or illegal transactions

Technical Violations

• Attempt to hack, reverse-engineer, or decompile the APP
• Use automated systems (bots, scrapers) to access the APP
• Interfere with or disrupt the APP's infrastructure
• Bypass security measures or access restrictions

Commercial Misuse

• Use the APP for unauthorized commercial purposes
• Resell or redistribute APP content without permission
• Collect user data for marketing without consent
• Advertise products or services without authorization

5. User-Generated Content

5.1 Content You Create

"User Content" includes any content you submit, post, or upload to the APP, including:

• Reviews and ratings
• Photos and videos
• Comments and forum posts
• Travel itineraries and tips
• Profile information

5.2 Content Ownership

You retain ownership of your User Content. However, by posting content, you grant UBCG:

• A non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the APP
• The right to modify content for formatting purposes
• The right to use content for promotional purposes (with attribution where appropriate)

5.3 Content Standards

Your content must:

• Be accurate and based on genuine experiences
• Respect Moroccan cultural and religious values
• Not infringe on others' intellectual property rights
• Not contain personal information of others without consent
• Comply with all applicable laws

5.4 Content Moderation

We reserve the right to:

• Review and moderate all User Content
• Remove content that violates these Terms
• Edit content for formatting or clarity
• Report illegal content to authorities

6. Bookings & Transactions

6.1 Third-Party Services

MoroccoNaut facilitates connections with third-party service providers including:

• Hotels and accommodations
• Tour operators and guides
• Restaurants and dining establishments
• Transportation services
• Activity and experience providers

6.2 Booking Process

When making a booking:

• Review all details carefully before confirming
• Understand the provider's cancellation and refund policies
• Provide accurate contact and payment information
• Save confirmation details for your records

6.3 Pricing & Payments

• All prices are displayed in Moroccan Dirhams (MAD) unless otherwise indicated
• Prices may include or exclude taxes and fees as indicated
• Currency conversion rates are provided for reference only
• Payments are processed securely through our payment partners

6.4 Cancellations & Refunds

Cancellation and refund policies vary by provider. Generally:

• Check each provider's specific policies before booking
• Cancellation requests must be made through the APP or directly with the provider
• Refund processing times depend on the payment method and provider
• Non-refundable bookings will be clearly marked

6.5 Disputes

For booking disputes:

1. First, contact the service provider directly
2. If unresolved, contact our support team at support@ubcg.net
3. We will assist in mediating but cannot guarantee resolution
4. Payment disputes may be escalated to your payment provider

7. In-App Purchases & Subscriptions

7.1 Premium Features

MoroccoNaut may offer premium features including:

• Ad-free experience
• Extended offline maps and guides
• Priority customer support
• Exclusive content and features
• Premium community badges

7.3 Payment Processing

In-app purchases are processed through:

• Android: Google Play Billing (Google's payment terms apply)

7.4 Cancellation

To cancel a subscription:

• iOS: Settings > Apple ID > Subscriptions > MoroccoNaut
• Android: Play Store > Account > Subscriptions > MoroccoNaut

Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

7.5 Refund Policy

• Refund requests must be submitted within 14 days of purchase
• Apple/Google refund policies apply for in-app purchases
• Contact support@ubcg.net for refund assistance

8. Intellectual Property Rights

8.1 Our Intellectual Property

The following are owned by or licensed to UBCG:

• MoroccoNaut name, logo, and branding
• APP design, interface, and user experience
• Original content, text, graphics, and images
• Software code and underlying technology
• Database structure and organization
• Trademarks and service marks

8.2 Restrictions

You may not:

• Copy, modify, or distribute APP content without permission
• Use our trademarks without written authorization
• Create derivative works based on the APP
• Remove copyright or proprietary notices
• Use content for commercial purposes without license

8.3 Third-Party Content

The APP may contain content from third parties, including:

• Service provider listings and descriptions
• Maps and geographic data (Google Maps)
• User-generated content
• Partner promotional content

Third-party content remains the property of its respective owners.

8.4 Copyright Complaints

If you believe your copyright has been infringed, contact us at:

9. Disclaimers & Limitations of Liability

• Service provider details are always up-to-date
• Prices and availability are accurate in real-time
• User reviews and ratings are authentic
• Travel advisories are comprehensive

9.3 Third-Party Services

We are not responsible for:

• Quality of services provided by third parties
• Actions or omissions of service providers
• Disputes between users and service providers
• Cancellations or changes by service providers
• Loss or damage during booked activities

9.4 Limitation of Liability

To the maximum extent permitted by Moroccan law:

• UBCG shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• We are not liable for events beyond our reasonable control (force majeure)

10. Indemnification

You agree to indemnify, defend, and hold harmless UBCG, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the APP
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Your interaction with service providers
• Any fraudulent or illegal activity by you

This indemnification obligation will survive the termination of your account and these Terms.

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, including:

• Moroccan Code of Obligations and Contracts (Dahir of 1913)
• Law 31-08 on Consumer Protection (2011, amended 2024)
• Law 09-08 on Personal Data Protection (2009)
• Law 53-05 on Electronic Exchange of Legal Data (2007)

11.2 Dispute Resolution Process

In case of a dispute, we encourage the following resolution process:

Step 1: Direct Communication

Contact our support team at support@ubcg.net to resolve the issue directly.

Step 2: Formal Complaint

If unresolved, submit a formal written complaint to legal@ubcg.net within 30 days.

Step 3: Mediation

If the dispute persists, parties agree to attempt mediation before litigation.

Step 4: Legal Action

If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Marrakech, Morocco.

11.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under Moroccan law, including rights under Law 31-08 on Consumer Protection.

12. Privacy & Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We never sell your personal data to third parties
• We implement industry-standard security measures
• You have the right to access, correct, and delete your data

13. Communication & Notifications

13.1 Communications from Us

By using the APP, you agree to receive:

• Transactional Communications: Booking confirmations, receipts, account updates
• Service Communications: Important updates, security alerts, policy changes
• Marketing Communications: Promotional offers, newsletters (with your consent)

13.2 Managing Preferences

You can manage your communication preferences:

• In-App: Settings > Notifications
• Email: Click "Unsubscribe" in marketing emails

Note: You cannot opt out of essential service communications related to your account or transactions.

13.3 Contact Methods

Official communications from MoroccoNaut will come from:

• In-app notifications
• Official social media accounts

14. Termination

14.1 Termination by You

You may terminate your account at any time:

• Through Settings > Account > Delete Account
• By emailing privacy@ubcg.net

14.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You pose a risk to other users or service providers
• Required by law or legal process
• We discontinue the service

14.3 Effects of Termination

Upon termination:

• Your right to use the APP ceases immediately
• Active subscriptions will not be renewed
• You may lose access to purchased content (except as required by law)
• Your User Content may be retained or deleted per our Privacy Policy
• Provisions that should survive will remain in effect

14.4 Surviving Provisions

The following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and UBCG regarding the APP.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to any affiliate or successor.

15.5 Force Majeure

We are not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or infrastructure failures.

15.6 Language

These Terms are available in multiple languages. In case of conflict, the English version shall prevail, except where local law requires otherwise.
